Congratulations to Dr. Youcef Bensala, (Department of Fiqh-usul and Applied Sciences) and Dr. Mohamed Cherif Benaouali, (University of Djilali Bounaama, Khemis Miliana, Algeria) on the publication of their latest book.

The book ” Introduction to Islamic Financial Transactions in Light of the Objectives of Shariah ” is a scholarly study that combines the juristic perspective with the Objectives of Islamic Law (Maqasid Ash-Shariah), It aims to keep pace with contemporary financial developments and to serve people’s everyday needs by simplifying Islamic financial jurisprudence and making it more accessible to researchers, merchants and students. The book was written in response to certain shortcomings found in some existing works, such as excessive elaboration, inadequate brevity, the complexity of terminology, and the lack of contemporary examples.

The book addresses the concept of wealth, financial transactions, and their related terminology. It also reveals the Shariah objectives and divine wisdom behind financial dealings in Islam. In addition, it highlights the foundational principles governing the prohibition of unlawful financial transactions and the underlying reasons for such prohibitions. Furthermore, it devotes significant attention to financial contract theory, including its rulings, conditions, and contractual forms, all supported by relevant contemporary examples.

To conclude, we present this modest work to the reader without claiming perfection or infallibility, humbly asking Allah Almighty to make it beneficial granting it integrity that earns the acceptance of fair-minded readers, knowledge that benefits researchers, and sound guidance that assists Muslim merchants in their dealings. Success is solely from Allah, who guides to the straight path and is Most Compassionate and Merciful to His servants.

يُعد كتاب «مدخل إلى فقه المعاملات المالية في ضوء المقاصد الشرعية» دراسةً تجمع بين النظرة الفقهية، والرؤية المقاصدية، تهدف إلى مواكبة المستجدات المالية وخدمة حاجات الناس اليومية؛ من خلال تبسيط فقه المعاملات المالية وتقريبها إلى الباحثين والتجار وطلاب العلوم الشرعية، وقد جاء تأليفه استجابةً لما تعانيه بعض المؤلفات من تطويل ممل أو اختصار مخل، ناهيك عن صعوبة المصطلحات، وغياب الأمثلة المعاصرة . وقد تناول الكتاب مفهوم المال والمعاملات المالية والمصطلحات المتعلقة بها، وكشف عن المقاصد الشرعية والحكم الربانية من التعامل بالأموال، كما سلط الضوء على أصول تحريم المعاملات المالية المحرمة وعلل حظرها، بالإضافة إلى تناول الكتاب جانباً مهماً في نظرية العقود المالية وأحكامها وما يتعلق بها من شروط وأحكام وصيغ..؛ معززا كل ذلك بأمثلة معاصرة .

وفي الأخير نضع جهدنا المتواضع بين يدي القارئ غير مدعين الكمال ولا العصمة في المقال، سائلين المولى سبحانه أن يكون قد وهب فيه من السلامة ما يكسبه رضى المنصفين، ومن الفقه ما يوجه به الباحثين، ويرشد تجار المسلمين، والله تعالى الموفق للسداد والمحقق للمراد إنه رؤوف بالعباد.
